3. ParaPresent is a marketplace, a platform that allows users to buy and sell digital assets in the form of NFTs. ParaPresent provides technological tools for creating NFTs and also offers a set of powerful tools to assist in celebrating holidays and gifting NFTs. ParaPresent is not a cryptocurrency exchange, broker, dealer, financial institution, payment processor, or financial services provider.
4. ParaPresent provides no guarantees and does not act as a participant or intermediary in transactions between you and other users. You are solely responsible for verifying the authenticity, legality, value, copyright, and accuracy of the NFTs you purchase from third parties through our Service. We make no representations, warranties, or endorsements regarding the identity, legality, functionality, or authenticity of either users or NFTs, including any associated content presented in our Service.

Our service provides you with an internal wallet for platform transactions and also supports the option to use an external wallet at your discretion. Your blockchain address serves as the primary form of identification, while the internal wallet ensures the convenience and security of your transactions.

In doing so, you acknowledge that ParaPresent is not obligated to notify you, inform you in advance, or disclose the details of its decision.
11(3) Without limiting the foregoing, by using the Service, you represent and warrant that:
(a) You do not reside, are not located in, and are not organized under the laws of any jurisdiction subject to a comprehensive embargo imposed by the government of Canada (hereinafter, an "Embargoed Jurisdiction");
(b) You have not been and are not subject to any sanctions imposed by the government of Canada, any other government, or the United Nations (hereinafter collectively, "Sanctions");
(c) You do not own or control, directly or indirectly, any person subject to Sanctions and are not a resident, organized, or residing under the laws of any Embargoed Jurisdiction;
(d) None of your employees, officers, directors, shareholders, or authorized representatives have been subject to Sanctions, are residents of an Embargoed Jurisdiction, or are organized under the laws of an Embargoed Jurisdiction, nor are they owned or controlled directly or indirectly by any person subject to Sanctions, nor are they residents, organized, or residing under the laws of an Embargoed Jurisdiction;
(e) You have not conducted and will not conduct transactions with any person or entity that falls under any of the provisions of (a)-(d);
(f) You have not conducted and will not conduct transactions on behalf of any person or entity that falls under any of the provisions of (a)-(d).
11(4) You also agree to comply with the above conditions throughout the term of this agreement. If you access or use the Service outside of Canada, you bear sole responsibility for ensuring that your access to and use of the Service in such country, territory, or jurisdiction does not violate applicable laws.
11(5) ParaPresent reserves the right to request additional information and necessary documents from you in certain situations, such as requests from government authorities, legal or regulatory requirements, or for providing requested services or investigating potential violations of these Terms. In such cases, ParaPresent reserves the right, at its discretion, to temporarily disable your account and restrict access to the Service until the required additional information and documents are provided. If you fail to provide complete and accurate information in response to such a request, ParaPresent may deny the restoration of your access to the Service.

(f) You have not conducted and will not conduct transactions on behalf of any person or entity that falls under any of the provisions of (a)-(d).

This world of digital artistry, along with exclusive content, information, and other unique materials, including but not limited to the ParaPresent logo and all its design elements, texts, graphics, data, software, audio recordings, and other files, as well as their harmonious arrangement and organization, are the exclusive property of ParaPresent, our affiliates, licensees, or users, as appropriate in each specific case.
14(2) You agree to comply with and respect all the above-mentioned ownership rights and commit not to undertake any actions that could infringe upon these rights. We, along with our affiliated entities, licensees, and users, in accordance with specific circumstances, reserve all rights to the Service and its content.
14(3) Every aspect of the ParaPresent trade name, logo, and trademarks, as well as any product or service names of ParaPresent, their elegant design, logos, and memorable slogans, are the intellectual property of ParaPresent or our affiliates or licensees. These elements represent a symbol of quality and originality and may not be copied, imitated, or used, in whole or in part, without our prior written permission.
14(4) You are strictly prohibited from using metatags or any other hidden text containing "ParaPresent" or any other names, trademarks, product, or service names of ParaPresent, our affiliates, or licensees without our express written consent. Additionally, the visual identity of the ParaPresent Service, including its appearance and overall aesthetics, represents a service mark, trademark, or trade dress of ParaPresent, symbolizing uniqueness, and may not be copied, imitated, or used, in whole or in part, without our prior written permission.
14(5) All other third-party trademarks, registered trademarks, and product names mentioned within the Service or associated with content related to NFT files presented on the platform remain the exclusive property of their rightful owners. These trademarks and names may not be copied, reproduced, or used, in whole or in part, without proper authorization from their rights holders.
14(6) The mention of any products, services, processes, or other information, whether by name, trademark, manufacturer, supplier, or otherwise, does not imply endorsement, sponsorship, or recommendation by ParaPresent. If, during your use of the Service, you gain access to software, content, or other materials owned, controlled, or licensed by us, we grant you a limited, non-commercial, personal, non-transferable, and non-sublicensable right and license to access and view such software products, content, and materials provided through the Service. This includes the right to download one copy of the Application onto your device or equipment solely for the purpose of enabling your use of the Service in accordance with these Terms.

18(1) NFTs displayed on the ParaPresent platform are created by third parties, therefore ParaPresent makes no guarantees regarding third-party content you may see through our Service. You are responsible for verifying the legality, authenticity, and value of NFTs you purchase from third-party sellers. We also cannot guarantee that any NFTs visible on ParaPresent will always be available for viewing, purchase, sale, or gifting.
18(2) Our Terms govern the use of our Service, but it is important to understand that NFTs are available on public blockchains and may be bought, sold, or transferred directly between users, bypassing our Terms. NFTs may also be subject to NFT Terms set between buyers, sellers, and/or creators of NFTs. Therefore, when you interact with NFTs on ParaPresent, pay attention to any links to the NFT Terms and ensure you comply with them. ParaPresent is not a party to such NFT Terms, and we bear no responsibility for their compliance.
18(3) NFT sellers independently set prices for NFTs. Sellers are solely and personally responsible for paying all applicable taxes on the sale of NFTs. Additionally, there are various costs and fees associated with the purchase and sale of NFTs that ParaPresent does not control, regulate, or have any relation to, such as blockchain transaction fees, credit card processing fees, or other payment methods. These fees may be charged by third parties such as payment processors or blockchain validators and are not included in our fees. All fees for payment processing and blockchain validation are paid by NFT creators, buyers, and sellers individually in each case.

By following these links, you gain access to third-party content that is not controlled by ParaPresent and is subject to different Terms. You must independently review the Terms of other websites and applications, and you bear sole responsibility for the use of such third-party websites and applications.
ParaPresent bears no responsibility and has no control over links to third-party websites, services, and applications that may be located and displayed on the ParaPresent platform. By following these links, you gain access to third-party content that is not controlled by ParaPresent and is subject to different Terms. You must independently review the Terms of other websites and applications, and you bear sole responsibility for the use of such third-party websites and applications.
20. Removal of NFTs from the Platform.
20(1) ParaPresent may remove any NFT from the platform at any time, at its discretion, without prior notice. We are not obligated to notify you in advance or seek your approval if we decide to remove an NFT from display for sale or viewing because we deem the content of the NFT offensive to other users, illegal, or promoting acts of violence, vandalism, racism, extremism, etc. You may dispute this decision by contacting us, and we will review it, but we do not guarantee a reversal of our decision if the NFT content contradicts the law, commonly accepted standards of morality, or the standards of our Service.
20(2) We may restrict or completely terminate your access to our Service if your actions violate our Terms or if you use the Service for illegal activities.

21(4) You commit to not infringing on intellectual property rights or other rights of third parties, respecting the creative work and intellectual property on ParaPresent.
21(5) Your use of the ParaPresent Service will comply with the developer policy approved by us, thereby maintaining order and adherence to the rules of our platform.
21(6) You agree not to engage in activities related to money laundering, terrorism financing, or other illegal financial activities through the ParaPresent Service, maintaining high standards of ethics and legality.
21(7) You commit to using the ParaPresent Service in a way that does not interfere with, disrupt, or negatively impact other users' ability to fully utilize the Service, contributing to a harmonious and efficient digital community.
21(8) You commit to not distributing spam, including sending unsolicited NFTs, to ensure a comfortable interaction for users on the ParaPresent platform.
21(9) You agree not to manipulate prices, participate in fraud, or engage in any deceptive activities on the ParaPresent Service, upholding the principles of fairness and transparency.
21(10) You commit to not attempting to bypass the fee system established on the platform, maintaining fairness and honesty in financial relationships.
21(11) You commit to not using the ParaPresent Service to create or display content that promotes suicide, self-harm, hatred, or violence, striving to create a safe and respectful environment for all users.
21(12) You confirm your agreement not to use other users' accounts without their permission, respecting their personal rights and privacy on the ParaPresent Service.
21(13) You agree not to impersonate another individual or entity, nor to use someone else's wallets for transactions on ParaPresent, maintaining principles of honesty and authenticity.
21(14) You take responsibility for not engaging in activities aimed at artificially increasing the metrics of items or collections on the ParaPresent site, maintaining the authenticity and reliability of data.
21(15) You agree not to engage in the purchase, sale, or transfer of stolen items, items obtained fraudulently, or any other illegally acquired items, contributing to a safe and trustworthy environment on ParaPresent.
21(16) You commit to not using the ParaPresent Service for any illegal or unauthorized purposes, including creating or displaying illegal content, upholding compliance with laws and regulations.
21(17) You agree not to bypass rate limits, not to use multiple IP addresses to distort traffic sources on ParaPresent, ensuring fair and transparent use of Service resources.
21(18) You agree not to use unauthorized automated means to access the Service, extract data, or interfere with its operation, maintaining the efficiency and security of ParaPresent.
21(19) You commit to not using software or interacting with APIs that could harm the functioning of the ParaPresent Service, supporting its stability and reliability.
21(20) You confirm that you will not engage in reverse engineering, duplicating, decompiling, disassembling, or decoding any part of the ParaPresent Service, respecting the intellectual efforts and rights embedded in its creation.

22. Copyrights for NFTs Created by You and License Grant.
22(1) You agree that ParaPresent has the full right to use and display your content submitted, posted, or displayed on or through the Service. We do not claim ownership of the content, but we have the right to use and display it.
22(2) You confirm and warrant that you own or have obtained all necessary rights, licenses, consents, permissions, and authorizations to grant the rights described in this document for any content that you create, submit, post, promote, or display through the Service.
22(3) You are fully responsible for the content and metadata associated with NFTs and digital objects created by you. You represent and warrant that your content does not include materials protected by copyrights, trademarks, publicity rights, or other intellectual property rights, unless you have the necessary permission or legal right to publish such materials and to grant ParaPresent the appropriate license, and that your content does not violate any laws.
22(4) By interacting with our Service, which includes creating, submitting, posting, distributing, or displaying content, as well as complying with your responses to API metadata standards of ParaPresent, you grant us a global, non-exclusive, sublicensable, royalty-free license. This license allows us to use, copy, modify, and publicly display any content you offer, including but not limited to text, materials, graphic images, files, messages, comments, reviews, suggestions, creative ideas, unique concepts, interesting questions, valuable data, and any other information you post on or transmit through our Service. This includes any digital files, images, and other materials associated with any NFTs presented within our Service.
22(5) This License is granted by you for the purpose of using your materials for our current and future business needs, which include but are not limited to expanding, promoting, and improving our Service. We strive to ensure that your creative contributions are respected and used in a way that promotes the growth and development of our Service, while providing new opportunities to showcase your creative potential and strengthen our community.

23. Copyright Protection.
23(1) ParaPresent strictly adheres to the guidelines and provisions of the Copyright Act, as well as other laws related to intellectual property. As part of our copyright protection policy, we will take active steps to remove content that infringes upon these rights, in accordance with any received infringement notices. In cases where it is determined that a user systematically violates intellectual property rights, that user's access to our Service will be immediately terminated.
23(2) If you discover that your content has been copied or used improperly and believe that it constitutes an infringement of your copyright or other intellectual property rights, we encourage you to file a complaint with us. To ensure prompt and effective handling of your complaint, it is important that you are either the rightful owner of the infringed rights or an authorized representative. 23(3) Your notice must contain the following:

23(4) The Service, including its design and any text, graphics, images, logos, page headers, button icons, URLs, and scripts contained within it, as well as proprietary content, information, and other materials, and all content and materials within it, including but not limited to the ParaPresent logo and all designs, texts, graphics, images, data, software, audio files, other files, and their selection and arrangement, are the property of ParaPresent, our affiliates, licensors, or users, as applicable. You agree not to take any actions that infringe upon these proprietary rights. We, our affiliates, licensors, and users, as applicable, reserve all rights to the Service and its content, including the exclusive right to create derivative works.
23(5) The name, logo, trademarks of ParaPresent, as well as any product or service names, designs, logos, and slogans of ParaPresent, are the intellectual property of ParaPresent or our affiliates or licensors and may not be copied, imitated, or used, in whole or in part, without our prior written consent in each specific case. You are not permitted to use metatags or any other "hidden text" containing "ParaPresent" or any other name, trademark, product or service name of ParaPresent or our affiliates or licensors without our prior written consent. Additionally, the "look and feel" of the Service is a service mark, trademark, or trade dress of ParaPresent and may not be copied, imitated, or used, in whole or in part, without our prior written consent.

24. Terms of Service.
24(1) You are solely responsible for ensuring the availability of a mobile device, a wireless data plan, software, an internet connection, and/or any other equipment or services necessary to download, install, and use the application. We do not guarantee that the application will be compatible with any specific device or data plan. Additionally, we do not promise that the application or service will be available in a specific geographic region.
24(2) By using the Service, you acknowledge the importance of conducting your own research (DYOR). You are solely responsible for verifying the accuracy, legality, authenticity, and other aspects of any NFT, collection, or account with which you interact through our Service. We make no representations, warranties, or endorsements regarding the authenticity, legality, or accuracy of any NFT, collection, or account within the Service.
24(3) You are responsible for all fees incurred while using the Service, including blockchain transaction fees, regardless of the success of the transaction. You acknowledge that these fees are non-refundable and final.
24(4) You are solely responsible for your use of the Service and for all information you provide, including compliance with applicable laws, rules, and regulations, as well as the terms of this Agreement, including established user behavior requirements.
24(5) Upon registering your account on ParaPresent, you agree to receive electronic communications from us. This may include emails, push notifications, text messages, and other forms of digital communication. These messages will play a key role in your interaction with us, providing important information about your account, including transaction updates.
Additionally, we reserve the right to send you marketing and promotional offers via email that we believe may be of interest to you. However, we want to emphasize that your consent to receive such promotional messages is not a requirement for using our Service. You may opt out of receiving such notifications at any time by using the unsubscribe option available directly in our Service or through your mobile device’s operating system settings. However, please note that certain critical service and administrative messages will be delivered to you regardless of your desire to unsubscribe, as they are necessary for the proper functioning of your account and the security of your data.
24(1) You are solely responsible for ensuring the availability of a mobile device, a wireless data plan, software, an internet connection, and/or any other equipment or services necessary to download, install, and use the application. We do not guarantee that the application will be compatible with any specific device or data plan. 25. Acceptance of Risk.
25(1) You acknowledge and agree that: The value of NFTs is subjective. NFT prices can experience significant fluctuations, and changes in the value of cryptocurrencies may also have a substantial and negative impact on the value of NFTs. You understand this subjectivity and volatility and recognize that you may incur financial losses.
25(2) A lack of use or public interest in the development and growth of decentralized ecosystems may negatively impact their development, as well as applications related to these ecosystems, which in turn may adversely affect the potential utility of NFTs.
25(3) The legal framework governing blockchain technologies, non-fungible tokens, cryptocurrencies, and other aspects of cryptography is unstable. The introduction of new laws or policies may have a significant negative impact on the development of the Service and the utility of NFTs.
25(1) You acknowledge and agree that: The value of NFTs is subjective. NFT prices can experience significant fluctuations, and changes in the value of cryptocurrencies may also have a substantial and negative impact on the value of NFTs. You understand this subjectivity and volatility and recognize that you may incur financial losses.
25(2) A lack of use or public interest in the development and growth of decentralized ecosystems may negatively impact their development, as well as applications related to these ecosystems, which in turn may adversely affect the potential utility of NFTs.
25(3) The legal framework governing blockchain technologies, non-fungible tokens, cryptocurrencies, and other aspects of cryptography is unstable. The introduction of new laws or policies may have a significant negative impact on the development of the Service and the utility of NFTs.
26. Assumption of Responsibility and Risks When Using the Service.
26(1) By confirming your agreement to the Terms of Use of the ParaPresent Service, you accept responsibility for fully indemnifying and defending ParaPresent and all its affiliates, including current and former employees, officers, directors, contractors, consultants, shareholders, suppliers, service providers, as well as parent and subsidiary companies, from all potential claims, losses, fines, and other legal judgments. This includes liabilities related to damages, taxes, fines, and interest, as well as legal costs arising from your use or misuse of the Service, reviews, violations of the Terms or laws, and any breaches of third-party rights or unlawful actions.
26(2) You agree to promptly notify ParaPresent of any claims and actively cooperate with us in defending them. You also acknowledge that ParaPresent and its affiliates have the right to control the defense and settlement of any claims. This indemnification is in addition to any other warranties stipulated in a written agreement between you and ParaPresent.
26(3) By using the ParaPresent Service, you do so entirely at your own risk. The Service is provided on an "as is" and "as available" basis, without any warranties from ParaPresent. We disclaim all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. ParaPresent and our suppliers are also not responsible for the Service meeting your requirements, uninterrupted or timely operation, or the accuracy, reliability, completeness, legality, or safety of the provided services.
26(4) When purchasing items created by third parties, there are risks, including but not limited to the risk of purchasing counterfeit goods, mislabeled items, and items subject to vulnerabilities in metadata or smart contracts. You confirm that you have conducted sufficient research before making decisions on selling, buying, or otherwise dealing with NFTs.

ParaPresent is not responsible for communication failures, errors, distortions, or delays that occur while using the Service or any blockchain network.

ParaPresent cannot guarantee the security of data disclosed by you on the internet and is not responsible for any security breaches. Advice or information received from ParaPresent through the Service does not create warranties not expressly stated in this agreement.
27(2) ParaPresent is also not liable for losses or injuries due to vulnerabilities or failures in software, blockchains, or other features related to NFTs. Additionally, ParaPresent is not responsible for losses or damage due to delays or the failure of developers to report issues with the blockchain supporting NFTs.
27(3) ParaPresent is not responsible for determining or paying taxes related to your NFTs or their purchase/sale. You are fully responsible for determining and paying all applicable taxes related to your transactions. This includes the obligations of withholding, collecting, reporting, and remitting relevant tax amounts to government authorities.
27(4) ParaPresent does not own or control smart contracts created by third parties and is not responsible for their operation and functionality. We also do not control public blockchains with which you interact, as well as specific smart contracts and protocols that may be required for your transactions. Blockchain transactions are irreversible, and ParaPresent cannot cancel them.
27(5) ParaPresent does not guarantee that the NFTs you purchase will always be available for viewing on the platform, and the inability to display items on ParaPresent or use the Service in connection with the purchase, sale, or transfer of items does not give grounds for claims against ParaPresent.
27(6) ParaPresent interacts with third-party platforms and services. ParaPresent does not guarantee that our relationships with them will be maintained. The terms or prices of these third-party platforms and services may change at any time, and we have no control over or influence on them.
27(7) ParaPresent reserves the right to remove NFTs from display due to these or other issues. ParaPresent does not guarantee that the NFTs you purchase will always be displayed on the platform.
27(8) To the maximum extent permitted by law, you acknowledge that ParaPresent and its service providers will not be liable to you or any third party for: (A) lost profits, indirect damage, typical, incidental, special, or punitive losses arising from these terms, services, products, third-party websites, and products, including losses related to lost profits, revenue, business, expected savings, usage, income, or data, even if it results from strict liability or other grounds, including negligence, breach of contract, and others, even if ParaPresent or its service providers were advised of the possibility of such losses; or (B) any other claims, actions, or damages arising in connection with these terms, the use or provision of services. The use of services, products, or third-party websites and related products is at your own risk, and you bear full responsibility for any damage to your computer or mobile device, as well as for data loss.
27(9) We strongly recommend that you review our Privacy Policy, which details how we process, use, and protect information related to you ("Your Information"). Your interaction with our Service and the provision of any data through it implies your informed consent to the principles and terms outlined in the Privacy Policy. By confirming your consent, you expressly authorize the collection, use, and dissemination of your personal information in accordance with our established privacy rules. This includes, but is not limited to, the processing of your personal information to improve the quality of our Service and to provide you with more targeted and personalized services.
27(10) In the event of disputes with other users, you release ParaPresent from all claims, demands, and damages of any kind and nature, known and unknown, arising from such disputes. You waive any legal protections that might limit the scope of this release, including claims that you know or suspect to exist at the time of agreeing to this release.
27(11) Notwithstanding any provisions contained in this document, in any circumstances, the maximum aggregate liability of ParaPresent related to these terms, access to services, content, NFTs, or any ParaPresent products and services will not exceed (A) USD 100 or (B) the amount received by ParaPresent for services directly related to the subject of the claim. These limitations apply even if the provided remedy fails in its essential purpose.

In such cases, ParaPresent does not offer services for resolving these disagreements, and the parties must independently find ways to resolve their conflicts.

Under our Arbitration Agreement, you agree that any dispute or claim arising in connection with your use of the ParaPresent Service, including but not limited to products and services offered through the Service, as well as any aspects of your relationship with ParaPresent, will be resolved through mandatory arbitration. This rule also applies to preliminary questions about the arbitrability of such disputes or claims. Exceptions to this rule include situations where: (a) you or ParaPresent may bring claims in small claims court if the matter falls within the jurisdiction of such a court and is limited to an individual and not a class action basis; and (b) in cases of intellectual property rights violations, where you or ParaPresent may seek an injunction or other protective measures in a court of competent jurisdiction.
29(3) Dispute Resolution Procedure.
Pre-Arbitration Dispute Resolution: You and ParaPresent agree to make every effort to resolve any disputes amicably before initiating arbitration, small claims court proceedings, or seeking equitable relief for intellectual property rights violations. If you are represented by an attorney, they may attend the Conference, but your personal participation is required. Similarly, if a ParaPresent representative is accompanied by an attorney, their participation is allowed, but ParaPresent ensures active participation by its representative.
29(5) Tolling of Statute of Limitations.
During the parties' participation in the informal dispute resolution process and the Conference, under these provisions, the statute of limitations and deadlines for filing claims are temporarily suspended.
29(6) Transition to Arbitration.
If, within 30 days of starting the dispute resolution process, the parties do not reach an agreement, either party may initiate arbitration, file a claim in small claims court, or seek an injunction in cases involving intellectual property rights violations.
29(7) Arbitration Rules and Venue.
The Ontario International Commercial Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement. To initiate arbitration after participating in the dispute resolution procedure, submit a request for arbitration with a description of your claim to ParaPresent's registered agent at: Suite 400, 901 King St. West, Toronto, ON, M5V 3H5, Canada, tel: +1(647)9481141. Disputes involving less than CAD 250,000, excluding attorney's fees, interest, penalties, or other damages, and claims exceeding the value of lost property, will be handled under the latest version of ADR Chambers' Simplified Arbitration Rules; other claims will be governed by ADR Chambers' Comprehensive Arbitration Rules. The ADR Chambers rules can be found at adrchambers.com. If ADR Chambers is unavailable, the parties will select an alternative arbitration forum. You are responsible for all additional expenses related to arbitration, including attorney and expert witness fees. Arbitration can take place by phone, video conference, or in writing at a location convenient for you. Any decision of the arbitrator may be confirmed in an Ontario court.
29(8) Arbitrator's Authority.
The arbitrator has exclusive authority to determine the enforceability and scope of this Arbitration Agreement, including disputes regarding its interpretation and validity. Arbitration determines the rights and obligations between you and ParaPresent. The arbitrator has the authority to grant partial or full relief, as well as monetary damages and non-monetary remedies. The arbitrator will issue a written decision outlining the essential findings and conclusions. The arbitrator's decision is final and binding on both parties.
29(9) Waiver of Jury Trial.
YOU AND ParaPresent WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY. Instead, all disputes and claims will be resolved through arbitration under this agreement, except as described in the section regarding the application of the Arbitration Agreement. The arbitrator may award the same relief as a court and must follow these terms as a court would. However, there are no judges or juries in arbitration, and the ability to appeal an arbitrator's decision in court is limited.
29(10) Waiver of Class Actions and Collective Arbitration.
ALL CLAIMS AND DISPUTES UNDER THIS ARBITRATION AGREEMENT MUST BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION. Only individual remedies are available, and claims by multiple users, individuals, or entities cannot be combined. If a court rules that any part of this subsection is unenforceable for a particular claim, that claim will be handled in Ontario provincial courts. All other claims will be subject to arbitration.
29(11) Severability.
If any part of this Arbitration Agreement is found to be invalid or unenforceable, that part will be severed, and the remainder of the agreement will remain in effect.
29(12) Survival of Agreement.
The Arbitration Agreement remains valid even after the end of your relationship with ParaPresent.

Any disputes between the parties that are not subject to arbitration under the relevant section or are not heard in small claims court will be resolved in the provincial or federal courts of Ontario, located in that province.
30. Termination of Agreement.
30(1) Automatic Revocation of Licenses.
In the event that you violate any of the terms of this Agreement, all licenses granted to you by ParaPresent will be automatically revoked. ParaPresent reserves the right, at its discretion and without prior notice, to suspend, limit, disable, or fully terminate your access to the Service, including deleting your account. This may be done for any reason, without liability on the part of ParaPresent and without any obligation to refund any amounts you may have paid.
30(2) Rights to NFTs After Termination of Agreement.
Despite the termination of your account or restrictions on your access to the Service, you retain ownership of your NFTs and may continue to use them through public blockchains, other wallets, platforms, or Web3 websites.

31. Severability of Agreement.
Exclusion of Invalid Provisions: If any condition, clause, or provision of this Agreement is found by a court to be invalid or unenforceable, such condition, clause, or provision will be excluded from the Agreement without affecting the validity and enforceability of the remainder of the Agreement.

Compliance with Export Restrictions: You agree not to export or re-export the Service or other materials provided by ParaPresent to countries requiring special licenses or government approval without proper authorization. The Service must not be exported or re-exported to countries under sanctions or designated as supporting terrorism, nor to individuals listed on the relevant lists of Canada's Ministry of Foreign Affairs or other government authorities. You confirm that you do not reside in these countries and are not included in these lists, and you take responsibility for complying with all applicable export laws of Canada.
